These Terms of Service ("Terms") govern your access to and use of the website at lightbulblabs.net (the "Site"), operated by Lightbulb Labs LLC, a California limited liability company ("Lightbulb Labs", "we", "us", "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 13 years old to use the Site. By using the Site, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Use of the site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

You may view, download, and print content from the Site for personal, non-commercial use only, provided you do not modify it and you keep all copyright and other proprietary notices intact.

Software products published by Lightbulb Labs are governed by their own terms of service or end-user license agreements ("Product Terms"). In the event of a conflict between these Terms and any Product Terms with respect to a particular product, the Product Terms control for that product.

The Site may link to or reference third-party websites, services, or resources that are not owned or controlled by Lightbulb Labs. We are not responsible for the content, policies, or practices of any third-party services. Your use of any third-party services is at your own risk and subject to their terms.

5. Feedback

If you send us suggestions, ideas, or other feedback about the Site or our products, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use that feedback for any purpose, without any obligation to you.

6. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. LIGHTBULB LABS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE ACCURATE, COMPLETE, OR RELIABLE.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LIGHTBULB LABS OR ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE — WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT LIGHTBULB LABS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ANY EVENT, LIGHTBULB LABS' AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

8. Indemnification

You agree to defend, indemnify, and hold harmless Lightbulb Labs and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.

9. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, indemnification, and governing law — will survive.

10. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts.

11. Changes to these terms

We may revise these Terms at any time by posting an updated version on this page and revising the "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

12. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Lightbulb Labs regarding the Site, and supersede any prior agreements on that subject. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them freely.
